Plaintiff underwent a two-level cervical fusion and claimed medical specials of $221,000.00. Plaintiff was a passenger in a car involved in a low impact auto accident. Defendants claimed the impact was too minor to have caused an aggravation of plaintiff’s well documented, significant degenerative arthritis in her spine. Plaintiff received $125,000 in payments from other insurers prior to trial. The jury agreed with the defense and dismissed the plaintiff’s suit finding that the accident did not aggravate the plaintiff’s condition and cause the need for surgery. Defense verdict.
